The community is regulated in several ways which intend to protect the association and its members (the homeowners) with the intention to promote an appealing community which protects property values. Rules set expectations for architectual changes, guidelines for working with your neighbors and common-sense conduct of all residents in homes intended to preserve everyone's right to enjoy their homes peacefully.
The primary source documents homeowners should reference: the Declaration, and the Community Standards.
The Declaration was originally filed in 2018 by our developer Kolter Land Partners, in compliance with all state and federal laws at that time. In 2025, members of the association voted for its first Amendment which centered mostly around reform of 12.22 Leases to make the community less investor friendly. This document can be amended with the approval of 10 percent of the community (230 affirmative votes) and is filed with Manatee County.
The Declaration also contains other language, establishing the CDD, our construction phases and our Bylaws which simply dictate the procedures for the HOA and its Board of Director's structure and operation.
The Community Standards further regulate the community, focusing on homeowner lot standards. While there is overlap in the items contained between this and the Declaration, they must not conflict with or regulate in contrary to what is filed in the Declaration. This document is amended much more routinely by a process carried out by the Board of Directors at meetings held monthly for the most part. When changes are desired, ideas proposed to the board of directors are discussed at meetings. The community is invited to comment and provide feedback. The board will come up with a proposal and make it available to homeowners (typically online) for review at least 14 days before the meeting of the vote. Once passed, the revision is enacted. This vote is by the board of directors who represent homeowners and are present at the meeting.
Municipal, State and Federal Law: Generally law which was in effect at the time the declaration was filed in 2018 over rules the standards of our documents. Rules of the HOA are binding on homeowners as of acceptance of their deeds until they are successfully challenged in a court of law.
